The account of the death of Palinurus at the end of Aen. 5 raises to a higher level of importance a figure who has previously seemed very much a minor character in the Aeneid. This is achieved partly by the narrative brilliance of Virgil's account of his destruction by Somnus, and partly also by the atmosphere of solemn mystery which surrounds his fate. This solemn note is first struck in the passage which directly prepares the way for Palinurus' death. (...) Background Euthanasia is a topic of intense ethical debate and it is illegal in most countries at present, including Sri Lanka. The aim of this descriptive cross-sectional study of medical students and practicing doctors was to explore the acceptance of euthanasia and physician assisted suicide, and factors influencing this opinion. Methods A customised online questionnaire which explored opinions on euthanasia was administered to first and final year medical undergraduates in University of Colombo and practicing doctors with more than 5 years (...) of work experience at The National Hospital of Sri Lanka. Attitudes on euthanasia and PAS were also assessed with the attitudes towards euthanasia Scale, which is a 10-item questionnaire. Results A total of 425 individuals responded, which included 143 first-year medical undergraduates, 141 final-year medical undergraduates and 141 practicing doctors. More participants favoured legalizing euthanasia than those directly opposing it, but a significant proportion remained undecided. The mean scores of ATE questionnaire from the whole sample were generally unfavourable towards euthanasia/PAS. Accepting euthanasia as an option for oneself was the strongest predictor of favouring euthanasia/PAS or supporting its legalization. Conclusion In this cross-sectional survey, more respondents supported legalisation of euthanasia in Sri Lanka than those openly opposing it. Yet, a significant minority that responded as “undecided” for legalisation, were more likely to have unfavourable ATE. (shrink)

As a student and collaborator of Louis Agassiz on the study of fishes, F. W. Putnam gave promise of becoming a leading ichthyologist with special interest in taxonomy generally and the Etheostomidae in particular. While he was noted briefly in these fields, contributed a number of minor papers, and aided in the posthumous publications of some of Agassiz's work on fishes, he neither reached his original goal nor completed his major projected works. Patients who search for a better treatment, an increased quality of life, or even a chance to preserve life itself may claim to have an interest in accessing investigational medicinal products (IMP), particularly when no validated treatment for their disease or condition exists. For many, awaiting the uncertain and time-consuming process of converting an IMP into an approved drug may not appear a realistic option, as prognoses may be grim and a dramatic outcome may seem hard to avert. Gaining access (...) to an IMP, however, often proves to be a difficult enterprise with a highly uncertain outcome. In addition, the process of seeking access to IMP is surrounded by various ethical issues that will be explored in this article. This paper explores the ethical concerns in two potential tracks of seeking access to IMP for minors: on an individual basis, or collectively, as a patient organisation. In this discourse, several unique ethical and regulatory concerns related to the direct negotiation of access to IMP for minor patients are identified, with a focus on product safety, the recruitment of research subjects, the unnoticed entry of market mechanisms in the recruitment of research subjects, and the sidelining of third parties in the recruitment process. The paper concludes with a concise reflection on the way forward. The quest for access to investigational drugs is particularly relevant to paediatric practice, in which a significant share of the drugs prescribed has never been tested in children or labelled for use in the paediatric population. This paper operates from the assumption that revolution is a legitimate tool for members of oppressed minority groups to secure their rights. I argue that this type of robust right of revolution cannot be derived from Locke’s justification of revolution in the Second Treatise. For Locke, revolution is justified when the government uses its power in a manner contrary to the principles on which the state was established. Whether or not an action is contrary to these principles is determined by (...) the people as a whole (i.e., the majority). Members of oppressed minority groups, therefore, would be justified in exercising their right of revolution only if they could garner support from a majority of the citizenry. In many instances, satisfying this criterion would require oppressed individuals to receive support from their oppressors—a practical impossibility. Since this requirement is rooted in Locke’s account of the origins of civil society, if it is the case that revolution is a legitimate tool for members of oppressed minority groups to secure their rights, then it would be necessary to look elsewhere for theoretical support to justify a robust right of revolution. I argue that such support can be found in a deontological account of civil society. (shrink)

What is the concept of sense developed by Deleuze in his 1969 Logic of Sense? This paper attempts to answer this question analysing the three dimensions of language that Deleuze isolates: the primary order of noises and intensities ; the secondary order of sense ; and the tertiary organisation of propositions. What renders language possible is that which separates sounds from bodies and organises them into propositions, freeing them for the expressive function. Deleuze argues that it is the dimension of (...) sense that brings about this genesis of language, and he analyses in detail the three syntheses that bring about the production of this surface of sense. Yet Deleuze also distinguishes between two types of non-sense: the nonsense of Lewis Carroll's portmanteau words, which remain ensconced in the dimension of sense, and the more profound nonsense of Antonin Artaud's psychotic scream-breaths, which penetrate the almost unbearable world of the primary order of noise and intensities. In the end, the focus of Logic of Sense is less the surface domain of sense than the primary depth of corporeal intensities. What Deleuze calls a ‘minor’ use of language is nothing other than an intensive use of language that constitutes a principle of metamorphosis. (shrink)

This is a commentary on the Aesthetic and Analytic of the Critique of Pure Reason with frequent reference to the much neglected Methodology and a very brief discussion, in the final chapter, of the Dialectic. Dryer insists that the fundamental question of the Critique is how metaphysical judgments, i.e., judgments about how things are in general, can be verified; that it is neither a theory of knowledge or experience nor the exposition of a system of metaphysical principles except insofar as (...) such concerns are ancillary to the primary task; and that the literature on the first Critique, including Paton's and Kemp Smith's interpretations of it as a "metaphysic of experience," fails to understand Kant's argument by failing to accept Kant's description of his task. In the central chapter, "Verification in Geometry and Metaphysics," Dryer gives a detailed analysis of Kant's theory of verification in geometry and the way in which this is related to his final answer to the question of verification in metaphysics, with emphasis on imagination and the discussions of the Methodology. Chapters devoted to the First and Second Analogies and the Axioms of Intuition follow for the sake of illustration. The emphasis on verification and a large measure of freedom from Kantian terminology give the analyses a freshness which is only partially destroyed by the highly repetitious style. The images of human suffering from New Orleans in the aftermath of Hurricane Katrina remain seared in our nation's collective memory. More than 8 years on, the city and its African-American population still have not recovered fully. This reality highlights an important truth: the disturbances that accompany climate change will first and foremost affect minority communities, many of whom are economically disadvantaged. This paper: (1) describes how Hurricane Katrina, an example of the type of natural disaster that will become more (...) prevalent with intensifying climate change, has impacted the black community of New Orleans; (2) explores the notion that African Americans, in the midst of racial oppression, have developed a unique and powerful brand of environmental thought that has much to contribute to mainstream environmentalism; and (3) argues that the voice of the black community, which has a vested interest in climate outcomes, is critically needed in today's climate debate. The hypothetical social contract between a profession and society exchanges the privilege of self-regulation for the profession's promise to regulate itself in the public interest. When it no longer appears that the profession is exercising its privilege responsibility, there will be pressure to reform the regulation of the market for legal services, for example by allowing non-lawyers to provide legal services, or permitting lawyers to practice in partnerships with non-lawyers. So far the American profession has been relatively successful at resisting (...) reform, and the American Bar Association's Ethics 20/20 Commission wrapped up its business by proposing only a few minor, technical changes to the rules of professional conduct. One way the profession has fended off attempts to enact more comprehensive reforms is by appealing to professional core values. This article presents several claims about professional core values and reform of professional regulation. First, the American profession has not been particularly rigorous in defining a set of core values that appeal to the interests of clients or the public interest and are not merely a rearguard attempt by the profession to protect its monopoly. Second, and related, professional core values are plural in nature and vary in application considerably according to the context. Third, there is no reason that reforms cannot be considered that better serve interests such as access to justice while also respecting core values. Fourth, regulatory form is rather far down the list of threats to professional core values, after forces such as the increasing power of in-house counsel. The conclusion is not that there is no such thing as core values, but that if the profession continues to appeal to them as a rhetorical makeweight, it may find itself overwhelmed by pressures for reform. When attempting to capture the concept of enlightenment that underlies and motivates philosophical (and political and scientific) developments in the 18th century, historians of philosophy frequently rely upon a needlessly but intentionally exclusive account. This, namely, is the conception of enlightenment first proposed by Kant in his famous essay of 1784, which takes enlightenment to consist in the “emergence from the self-imposed state of minority” and which is only possible for a “public” to attain as a result of the public (...) use of reason, a privilege enjoyed by citizens and exemplified in the activity of the scholar. That women, among other groups, did not hold the status of citizens and did not enjoy access to the institutions or training that might gain them recognition as scholars is apparently not a concern for Kant, as he notes that the enlightened condition is likely out of reach anyway for “by far the greatest part of humankind (including the entire fair sex)” (AA 8:35). This naturally leads one to wonder what a history of this period could look like when considered from the perspective of a different, more inclusive conception of enlightenment, and in this chapter I propose to conduct an experiment of sorts just along these lines. As opposed to Kant’s exclusionary conception, I will instead take that proposed by his distinguished contemporary, Moses Mendelssohn, as my starting point. In addition to offering a conception of enlightenment distinctive both for its wide scope and progressive character, Mendelssohn’s has the advantage, or so I will show, of bringing the manifold intellectual contributions of a diverse set of women into focus, though it does more than this in that it also reveals these women to actively and critically engage with key aspects of Mendelssohn’s and others’ philosophical views. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. Daí, vieram me chamar. Causa dumbezerro: um bezerro branco, erroso, os olhos de nem ser – se viu –; e com máscara de cachorro. Me disseram; eu não quis avistar. Mesmo que, por defeito como nasceu, arrebitado de beiços, esse figurava rindo feito pessoa. Cara de gente, cara de cão: determinaram – era o demo. Povo prascóvio. Mataram. Dono dele nem sei quem for. Vieram emprestar minhas armas, cedi. Não tenho abusões. O senhor ri certas risadas... Olhe: quando é tiro de verdade, primeiro a cachorrada pega a latir, instantaneamente – depois, então, se vai ver se deu mortos. O senhor tolere, isto é o sertão. Um Moço de fora, teria aparecido, e lá se louvou que, para aqui vir – normal, a cavalo, dum dia-e-meio – ele era capaz que só com uns vinte minutos bastava... porque costeava o Rio do Chico pelas cabeceiras! Ou, também, quem sabe – sem ofensas – não terá sido, por um exemplo, até mesmo o senhor quem se anunciou assim, quando passou por lá, por prazido divertimento engraçado? Me concebo. O senhor não é como eu? Não acreditei patavim. Compadre meu Quelemém descreve que o que revela efeito são os baixos espíritos descarnados, de terceira, fuzuando nas piores trevas e com ânsias de se travarem com os viventes – dão encosto. Rincha- Mãe, Sangued’Outro, o Muitos-Beiços, o Rasgaem-Baixo, Faca-Fria, o Fancho-Bode, um Treciziano, o Azinhavre... o Hermógenes... Deles, punhadão. Se eu pudesse esquecer tantos nomes... Não sou amansador de cavalos! E, mesmo, quem de si de ser jagunço se entrete, já é por alguma competência entrante do demônio. Será não? Será? De primeiro, eu fazia e mexia, e pensar não pensava. Me agradou que perto da casa dele tinha um açudinho, entre as palmeiras, com traíras, pra-almas de enormes, desenormes, ao real, que receberam fama; o Aleixo dava de comer a elas, em horas justas, elas se acostumaram a se assim das locas, para papar, semelhavam ser peixes ensinados. Um dia, só por graça rústica, ele matou um velhinho que por lá passou, desvalido rogando esmola. O senhor não duvide – tem gente, neste aborrecido mundo, que matam só para ver alguém fazer careta... Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Esse Aleixo era homem afamilhado, tinha filhos pequenos; aqueles eram o amor dele, todo, despropósito. Dê bem, que não nem um ano estava passado, de se matar o velhinho pobre, e os meninos do Aleixo aí adoeceram. Andaço de sarampão, se disse, mas complicado; eles nunca saravam. Quando, então, sararam. Mas os olhos deles vermelhavam altos, numa inflama de sapiranga à rebelde; e susseguinte – o que não sei é se foram todos duma vez, ou um logo e logo outro e outro – eles restaram cegos. E o velhinho assassinado? – eu sei que o senhor vai discutir. Pois, também. Em ordem que ele tinha um pecado de crime, no corpo, por pagar. Se a gente – conforme compadre meu Quelemém é quem diz – se a gente torna a encarnar renovado, eu cismo até que inimigo de morte pode vir como filho do inimigo. Mire veja: se me digo, tem um sujeito Pedro Pindó, vizinho daqui mais seis léguas, homem de bem por tudo em tudo, ele e a mulher dele, sempre sidos bons, de bem. Eles têm um filho duns dez anos, chamado Valtei – nome moderno, é o que o povo daqui agora apreceia, o senhor sabe. Pois essezinho, essezim, desde que algum entendimento alumiou nele, feito mostrou o que é: pedido madrasto, azedo queimador, gostoso de ruim de dentro do fundo das espécies de sua natureza. Em qual que judia, ao devagar, de todo bicho ou criaçãozinha pequena que pega; uma vez, encontrou uma crioula bentabêbada dormindo, arranjou um caco de garrafa, lanhou em três pontos a popa da perna dela. O que esse menino babeja vendo, é sangrarem galinha ou esfaquear porco. – “Eu gosto de matar...” – uma ocasião ele pequenino me disse. Abriu em mim um susto; porque: passarinho que se debruça – o vôo já está pronto! Na fazenda O Limãozinho, de um meu amigo Vito Soziano, se assina desse almanaque grosso, de logogrifos e charadas e outras divididas matérias, todo ano vem. Em tanto, ponho primazia é na leitura proveitosa, vida de santo, virtudes e exemplos – missionário esperto engambelando os índios, ou São Francisco de Assis, Santo Antônio, São Geraldo... Eu gosto muito de moral. Raciocinar, exortar os outros para o bom caminho, aconselhar a justo. Minha mulher, que o senhor sabe, zela por mim: muito reza. Ela é uma abençoável. Compadre meu Quelemém sempre diz que eu posso aquietar meu temer de consciência, que sendo bem-assistido, terríveis bons-espíritos me protegem. Ipe! Com gosto... Beardsley's exposition of his large subject shows lucidity, objectivity, deftness, and a good sense of proportion; and these virtues become more apparent the closer his history approaches the complex diversity of contemporary aesthetic speculation. Especially skillful are the succinct accounts of those aspects of each philosopher's thought which, though not directly concerned with aesthetics, are necessary for a full understanding of his aesthetic theories. Beardsley himself remains neutral, arguing neither for nor against the theories he analyzes. Some may feel that (...) the visual arts are slighted, but this is a minor criticism of a very informative and illuminating book.—W. B. K. (shrink)

Themistokles was ostracized in the late 470's, probably in spring 471 or 470; if we are to believe Thucydides, he did not write to Artaxerxes in Persia until 465 at the earliest. In some way or other his stay in Argos and visits to the rest of the Peloponnese, his wanderings in northern Greece, and his delay in Asia Minor must be extended to fill this gap of at least five years. There is evidence of a sort, there are (...) arguments good and bad for the lengthening or shortening of any of these episodes, but none of this evidence or argument is conclusive. Between 470 and 465 no event in Themistokles' life can be securely dated; there is no fixed chronological pattern into which a reconstruction of the political history of Athens and the Peloponnese during these years must fit. Since the reconstruction which I attempt here is itself based on evidence which is far from adequate, plausibility is the most that can be claimed for it or for the chronological scheme which I infer from it. BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. In his recent book, Liberalism, Community and Culture, Will Kymlicka defends collective rights for some minority groups—and particularly for indigenous peoples in North America—by trying to show that secure cultural belonging is of great value, and rights to protection and autonomy for minorities, including some collective rights, are justified by the special disadvantages some minorities face in enjoying secure cultural membership. Kymlicka defends these claims from within a liberal perspective that draws heavily on Rawls and Dworkin and that denies that (...) groups are independent sources of moral claims. In this paper I am mainly concerned with how to defend the first of these claims, which I shall call the “Value Thesis.” One reason for being interested in the justification of the Value Thesis is that some version of it is a key part of most arguments for minority and collective rights. Another reason is that the Value Thesis is important to communitarians who frequently base their claims about the importance of community on the value of belonging. (shrink)

Ryle's recent retirement after almost a half-century of study, teaching and writing might well be regarded as the end of an era. A large segment of the philosophical world has come to regard him as the embodiment of the spirit of Oxford. His clear and informal style, his gift for fresh analogies and striking similes, his mastery of the epigram, have set new literary standards for philosophical writing. Largely responsible for inaugurating the B. Phil. and D. Phil. programs after World (...) War II for the benefit of graduate students from abroad, Ryle both as Waynflete professor of metaphysics and editor of Mind has enormously influenced the thinking of Anglo-American philosophers. Apart from his Concept of Mind, Dilemmas and Plato's Progress, his writings have taken the form of reviews, short articles or essays addressed to specific philosophical issues. Though many of these have become minor classics and have graced innumerable anthologies, it is only now that we have virtually the whole of this important segment of his writings available in book form. With the exception of four essays published originally in French, the papers in these two volumes have been published previously in English, mostly in the Proceedings of the Aristotelian Society, Analysis or Mind. They range in time from his early days at Oxford to 1968 and cover a wide range of topics, mainly in the areas of philosophical methodology, the philosophy of logic and the philosophy of mind. Only the fields of moral, political and aesthetic philosophy are comparatively neglected. The first volume contains his critical essays on individual thinkers. They include studies on Plato, Locke and Hume as well as his pieces on such contemporary thinkers as Husserl, Heidegger, Carnap, Wittgenstein, G. E. Moore and John Anderson, who dominated the Australian scene during the first half of this century. The second volume contains 37 pieces dating back to 1929. It is worth mentioning that despite their brevity, Ryle's introductions to these volumes throw considerable light on his philosophical development. When we look up a word in a dictionary, we want to know not just its meaning but also its function and the circumstances under which it should be used in preference to words of similar meaning. Standard dictionaries do not address such matters, treating each word in isolation. R. M. W. Dixon puts forward a new approach to lexicography that involves grouping words into 'semantic sets', to describe what can and cannot be said, and providing explanations for this. He (...) provides a critical survey of the evolution of English lexicography from the earliest times, showing how Samuel Johnson's classic treatment has been amended in only minor ways. Written in an easy and accessible style, the book focuses on the rampant plagiarism between lexicographers, on ways of comparing meanings of words, and on the need to link lexicon with grammar. For decades, the discussion on children’s competence to consent to medical issues has concentrated around normative concerns, with little progress in clinical practices. Decision-making competence is an important condition in the informed consent model. In pediatrics, clinicians need to strike a proper balance in order to both protect children’s interests when they are not fully able to do so themselves and to respect their autonomy when they are. Children’s competence to consent, however, is currently not assessed in a standardized way. (...) Moreover, the correlation between competence to give informed consent and age in children has never been systematically investigated, nor do we know which factors exactly contribute to children’s competence. ABSTRACT Imagine Oskar Schindler before the bar of moral theory. Schindler, a minor industrialist, sheltered more than 1000 Jews during the Holocaust. This would seem to be a record of virtue. Or is it? The dominant consensus in moral theory stresses a rationality and universality of judgement and action that Oskar did not even consider. Efforts to interpret Schindler in universal terms by reference to human rights or to the tenet that ought implies can are entertained and denied. If (...) Schindler's deeds are moral reality, the consensus in contemporary moral theory is the poorer for being unable to recognise them. Schindler's virtue is noteworthy in its own right and also as a limiting case for the mainline of contemporary moral theory. (shrink)

The base rate fallacy is a fallacy that occurs in probabilistic reasoning when available general information is omitted from the calculations and attention is given to specific information only. To illustrate this concept, this chapter discusses the scenario in Philip K. Dick's short story “Minority Report”, with some details augmented by the 2002 movie daptation by Steven Spielberg. The legislative approach seems to be based not just on the base rate fallacy but on assuming a base rate that is divorced (...) from reality, that the drug use rate among welfare applicants is significantly higher than the national rate. Once the accurate base rate is applied (be it the proportions between the races in the US population, or the percentage of drug users among the people receiving government welfare, etc.), one can clearly see that the original conclusion does not follow. For the senseless inira some manuscripts have inire or in arva, and the latter stands in the text of Baehrens . The attempts at emendation may be divided into two groups, those altering only inira and those tampering with ibat as well. I pass over the latter group, as Robinson Ellis, in his commentary, p. 125, has defended ibat sufficiently by reference to the frequent ñει in Babrius, Avianus’ model. The former group is represented by Withof and Robinson Ellis himself (...) ; and the editors of the Loeb text of the Minor Latin Poets, in 1934, had the verse printed with this in ora. Nobody seems to have seen that the verse-maker had to express the idea of the panther's pride. Therefore I propose ibat in (astra, a metaphorical phrase for the animal's conceit. For this metaphor cf. Horace's famous feriam sidera, for ibat Virg. Aen. 9. 641 sic itur ad astra, for in astra at the same place of the pentameter after a verb of motion Prop. 3. 18, 34 cessit in astra; Ov. Fast. 2. 478 and 3. 186 venit in astra. The responsible corporate officer doctrine is, as a formal matter, an instance of strict criminal liability: the government need not prove the defendant’s mens rea in order to obtain a conviction, and the defendant may not escape conviction by proving lack of mens rea. Formal strict liability is sometimes consistent with retributive principles, especially when the strict liability pertains to the grading of an offense. But is strict liability consistent with retributive principles when it pertains, not to grading, but to (...) whether the defendant has crossed the threshold from noncriminal to criminal conduct? In this essay, I review the two most plausible arguments supporting an affirmative answer in the context of the RCO doctrine. First, perhaps this doctrine reflects a rule-like form of negligence, akin to a rule that prohibits selling alcohol to a minor. Second, perhaps this doctrine expresses a duty to use extraordinary care to prevent a harm. Neither argument is persuasive. The first argument, although valid in some circumstances, fails to explain and justify the RCO doctrine. The second argument, a duty to use extraordinary care, is also inadequate. If “extraordinary care” simply means a flexibly applied negligence standard that considers the burdens and benefits of taking a precaution, it is problematic in premising criminal liability on ordinary negligence. If instead it refers to a higher duty or standard of care, it has many possible forms, such as requiring only a very slight deviation from a permissible or justifiable standard of conduct, placing a “thumb” on the scale of the Learned Hand test, identifying an epistemic standard more demanding than a reasonable person test, or recognizing a standard that is insensitive to individual capacities. However, some of these variations present a gratuitous or incoherent understanding of “negligence,” and none of them sufficiently explain and justify the RCO doctrine. (shrink)

The relationship between postcolonialism and feminism is often complicated and conflict-laden in its struggles against empire and patriarchy and its related social categories of oppression. The question is, How have African women in former colonies balanced their act? To address this question, the article focusses on Boleo, A Setswana Novel. Firstly, theories of post-coloniality and feminism are explored. Secondly, four creative African women writers are analysed for their take on the intersection of postcolonialism and feminism prior to reading Boleo, A (...) Setswana Novel. Thirdly, the analysis of Boleo indicates boundary crossing and cross-border oppressions and solidarity in the struggle against apartheid that features a female protagonist and other minor characters. It is proposed that because the novel equates apartheid with sin, it thus constructs salvation as the concerted communal efforts of resistance and suspicion towards the institutions of the oppressor, characterised by baitiredi [independent or self-actualising workers], a political movement founded by Boleo. The analysis of the African novel indicates that the struggle against colonial and patriarchy gave rise to the First Things First; Second Things First and Both Things Simultaneously approaches, which are evident within African women creative writers.Contribution: This article adheres to the journal’s scope and vision by its focus on a systematic, historical, exegetical and practical reflection within a paradigm in which the intersection of philosophy, religious studies, social sciences and humanities generate an interdisciplinary, multidisciplinary and transdisciplinary contested discourse. This is a study of "three metaphysical naturalists" who, although minor figures in their own right, nonetheless substantially influenced the direction and cast of American naturalism. The theme that unites them, according to Delaney, is their reaction to the bifurcation of mind and corporeal nature bequeathed to modern philosophy by Descartes and Locke. Morris R. Cohen, as a logician and philosopher of science, saw such a bifurcation as engendering conventionalism and a type of nominalism in science, and he reacted (...) against these with his own "logical realism." Frederick J. E. Woodbridge, working out of the Aristotelian and Spinozistic traditions, saw it as entailing subjectivism and attempted to counteract this by reasserting an "experiential realism." Roy Wood Sellars, himself an evolutionist, viewed the duality of mind and nature as a stimulus for the imaginative projection of idealism and the quietistic escapism of spiritualism, and countered these with a thorough-going "materialistic humanism." Delaney elaborates his thesis with clarity and cogency, using it as a vehicle to reconstruct the metaphysical views of the three men under study. He concludes with a critical comparison of the resulting "naturalistic reintegrations" of the mind-nature bifurcation: Cohen's through a more adequate philosophy of science, Woodbridge's by a realistic theory of experience, and Sellars' by an emergent theory of evolution. Delaney's critique focuses on the fundamental notions of existence, nature, and man, using these to expose essential differences between the "metaphysics" of the New York naturalists and that of Sellars. Woodbridge emerges from Delaney's analysis as the most substantial philosopher of the group. This is not a ponderous tome--it can be read practically at one sitting--but it succeeds in throwing new light on American naturalism in terms of its positive contributions to both the philosophy of nature and the philosophy of mind.--W. This is the third volume of the four volume history of philosophy being prepared under Gilson's editorship. There is no explicit mention of the division of labor between Gilson and Langan in the authorship of the present volume. The book is characterized throughout by the usual Gilsonian clarity and urbanity of style and, perhaps less fortunately, by the distinctively psychological-sociological approach he tends to take to non-medieval periods in the history of philosophy. Attention is directed to the evolutionary continuity of (...) major philosophic themes. Accordingly, the minor stepping-stone figures ordinarily omitted in general histories of philosophy are given full treatment--Montaigne, the Cambridge Platonists, Condillac, the Encyclopedists, Vico, Montesquieu, Condorcet, Lessing and Herder. This approach permits a more integrated picture of an historical period, but it also forces the authors to compress their treatment of the major philosophers, sacrificing the painstaking detail and relying on the insightful and suggestive thematic interpretation. The notes provide a real treasury of information, almost worth the price of the book.--W. G. E. (shrink)

In City of God 19.24, Augustine rejects Cicero's definition of res publica as a society founded on justice for a new definition focused on common objects of love. Robert Markus, Oliver O'Donovan, and a host of Augustinian political theologians have depicted this move as a positive gesture toward secular society. Yet this reading fails to account for why Augustine waited so long to address Cicero's definition, first discussed in Book 2, and for the radical dualism Augustine sets forth between the (...) two cities throughout his text. I argue, in line with Rowan Williams and John Milbank, for a minority reading of Book 19 that draws upon the narrative structure of City of God. In Books 3–5, Augustine recounts the history of the earthly city according to Rome's penchant for violence and idolatry, both a function of love for temporal goods. In Book 18, Augustine traces the history of the earthly city before Rome according to the same themes, completing a narrative argument that humanity has always been divided according to differing loves. Book 19 advances the idea that such idolatry is injustice—a failure to grant God the worship he is due. With the new definition of 19.24, Augustine retains Cicero's emphasis on the importance of virtue in civic society while characteristically shifting the terms of discussion from justice to love. While such a definition means that Rome can be called a res publica, it also prompts a negative judgment upon her history according to her objects of love. Given her violence and idolatry, Rome is no better than Assyria, Babylon, Egypt, and Greece—all subject to withering critique in Book 18. Thus, Augustine's new definition does not retract but extends the polemic of City of God. (shrink)

This study introduces Moscovici’s (1976, 1985) model of social influence to the accounting research domain, and uses an experimentto assess whether his theory explains how different types of discussion affects consensus in auditors’ ethical reasoning. Moscovici’s theory proposes three modalities of influence to describe how consensus is achieved following discussion: conformity, innovation, and normalization. Conformity describes the situation where individuals in the minority (e.g., auditors that do not accept the dominant view) accede to the majority (e.g., auditors that hold the (...) dominant view) as a result of group discussion. Innovation describes the situation where individuals in the majority accede to the minority. Normalization describes the situation where there is reciprocal influence.We find that conformity occurs when auditors are asked to prescriptively discuss what ideally “should” be the resolution to an ethicaldilemma. Normalization occurs when auditors are asked to deliberatively discuss what realistically would be the resolution to an ethical dilemma. The results of this study suggest that prescriptive discussion of an ethical dilemma encourages auditor groups to strive to find the best response to a moral dilemma if it is represented by the majority view. In contrast, deliberative discussion of an ethical dilemma may encourage the elimination of multiple viewpoints. The results of this study have important implications for understanding the social influence process that affects auditors’ ethical reasoning. (shrink)

Couples should not be allowed to select either for or against deafnessRecently, a US couple deliberately attempted to ensure the birth of a deaf child via artificial insemination.1 In opposing this action, I wish to focus on one argument they employ to support it, namely that in trying to have a deaf child, the women see themselves as no different from parents trying to have a girl. Girls can be discriminated against the same as deaf people and “black people have (...) harder lives”, one of them argues. They compare themselves to a minority group.2In using this argument to justify their attempt to secure the birth of a deaf child, they make four claims: It is not wrong to deliberately try to have a child who is expected to experience harm when the harms the child will experience are socially imposed. As a group experiencing socially imposed harms, the deaf are to be understood as a minority group. Women and people of colour also experience social harms, and are to be understood as minority groups. Because the deaf, women, and people of colour are all groups experiencing socially imposed harms, distinctions should not be made between attempts to have a child who will be a member of one of these groups.In reply, I will advance two arguments. First, I will argue that this couple’s decision is inherently just. Here I will acknowledge that this couple’s position draws a great deal of strength from its appeal to the experiences of women. My second argument will contend, however, that despite the reasonableness of this choice, the intentional selection of deaf children is indefensible. Granting this couple’s contestable assertion that the deaf ought to be understood as a minority cultural group, allowing individuals to secure the birth of deaf …. (shrink)

The unanimity theory is an account of property-level causation requiring that causes raise the probability of their effects in specified test situations. Richard Otte (1981) and others have presented counterexamples in which one property is probabilistically sufficient for at least one other property. Given the continuing discussion (e.g., Cartwright 1989; Cartwright and Dupre 1988; Eells 1988a,b), many apparently think that these problems are minor. By considering the impact of Otte's cases on recent versions of the theory, by raising several (...) new examples, and by criticizing natural replies, I argue that the problems for the unanimity theory are severe.
